Assignment 2: Midweek Production Assignment: Analyzing Jimmy Perk Case

This question involves a scenario in which a particular type of evidence plays a key role. Please be sure to identify that type of evidence and the rule or rules that address it.

The Perks and Browns are neighbors. The Perks’ son, Jimmy, does his homework from 5:00 P.M. to 6:30 P.M. every day. Then he often goes to see the Browns’ son, Mat. They play together in Mat’s backyard where Mat has a huge racecar track. Both the boys’ parents allow Jimmy to play in the backyard even when Mat is not there.

One day, Mrs. Brown left for a doctor’s appointment for 5:30 P.M. She forgot her wallet with her money and credit cards on the bench in her backyard. When she came back at 6:15 P.M., the wallet was missing.

The Browns think that Jimmy has stolen the wallet, and they want to sue him for theft.

Your office represents the Perks. Your lawyer asks you to research the law and predict the outcome of the case relying on similar cases and the rules.

In an interoffice memo in no more than 1,000 words, you need to:

• List the possible objections and contra-arguments the Browns may have.
• List the possible evidence the Browns may present.
• Include the findings of your research.
• Include the prediction of the outcome.
