Discussion Question 1: Barry Brown Case

Barry Brown, former Olympic soccer player and coach, applies for a job as the women’s soccer coach for a prestigious university. Not only does Brown not get the job, he is not even called for an interview. The athletics director says that she dumped all the resumes of men and considered only female applicants. Brown sues. The lawyer for the athletics director says that gender is a bona fide occupational qualification for this job.

Will this defense succeed? Why or why not?

 

Discussion Question 2: Construction Site Accident Case

You employ laborers for various construction projects for short-term seasonal work. The laborers are a part of road crews doing highway work. One of the flaggers is hit by a car and seriously injured. He files a workers compensation claim and simultaneously files for unemployment.

Will you contest either claim? Why or why not?

Construction workers collect unemployment for several months of the year when their projects end. Does this practice make economic sense? Why or why not? Explain your answer.
