Application: Where Does U.S. Law Come From?

Your task in this application is to write an essay that details the historical development of law in the United States.

Based on your reading, write a 200-word paper that includes each of the following elements:

  • Roman law and the development of written codes or law, as well as the Napoleonic Code
  • The development and importance of English common law
  • The doctrine of stare decisis

    Chapter 1, “Foundations of Law and the Role of Ethics in Business”

    In this chapter, you will explore what law is, why it is needed, where it came from, and what functions it serves. This section points out that although the modern emphasis in the United States is on statutory law, Americans also rely heavily on case law and the rules of administrative agencies to protect rights and correct wrongs. The concepts, definitions, and differences of civil law and criminal law also are introduced. Finally, the relationship between ethics and the law is developed.

    Focus on the definitions and concepts provided throughout the chapter. Review and think about the examples provided in the chapter that illustrate the major ideas being conveyed. Consider the history and development of law prior to the founding of the United States and the legal principles and theories upon which the U.S. legal system has been built.

    Chapter 2, “The Legal System of the United States and Its Constitutional Foundation”

    In this chapter, you will study the federal and state court systems of the United States. You will be introduced to the structure of each of these systems and to the types of cases that each court has the authority to decide. The chapter also briefly outlines the constitutional principles that have a significant effect on the U.S. legal system and that set it apart from legal systems in other countries.
